Introduction and Acceptance of Terms

Welcome to Indian Yoga School (“IYS,” “we,” “our,” or “us”). By accessing or using our website (https://indianyogaschool.com), including any features, content, or services provided through our platform (collectively, the “Service” or the “Platform”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). These Terms form a legally binding contract between you and IYS governing your access to and use of the Platform, whether as a guest, registered user, listing provider, or via any interactive feature.

By registering an account, listing a yoga centre, enrolling in programs, making transactions, or otherwise interacting with IYS, you acknowledge your understanding and acceptance of these Terms. Please read them carefully. If you do not agree to these Terms, you may not use the Platform or any of its services.

We may amend these Terms at any time by posting the updated Terms on our website and indicating the effective date. Significant changes will be notified via appropriate channels. Continued use after changes signifies acceptance of the new Terms.

Definitions and User Roles


1.1. Platform Overview

“Indian Yoga School” is a web-based platform built on the Laravel Framework that connects yoga centres (“Yoga Centres,” “Vendors”) with students (“Students”) enrolling in yoga teacher trainings and guests (“Guests”) participating in retreats, workshops, and other short-term programs, enabling them to discover, book, and pay seamlessly.

1.2. User Categories

Yoga Centres (Vendors): Registered organizations or individuals managing yoga facilities who use the Platform to list and promote programs, manage bookings, and receive payments.

Students & Guests (Users/Consumers):

  • Students: Individuals registered to discover and enroll in long-term programs such as yoga teacher trainings, make payments, and interact with Yoga Centres.

  • Guests: Individuals interested in short-term offerings such as retreats, workshops, or drop-in sessions, with more limited engagement compared to Students.

Visitors: Unregistered individuals browsing public content or listings without transacting or accessing restricted features.

1.3. Additional Definitions

  • Account: Registered user profile containing personal, contact, and activity information.

  • Program: Any retreat, workshop, teacher training, class, or event listed by a Yoga Centre for booking via the Platform.

  • Listing: A public-facing webpage or entry describing a Yoga Centre’s Program available for booking.

  • Transaction: Any completed exchange of value/payment via the Platform’s payment system.

  • Service Fee: Fees levied by IYS for facilitating bookings, processing payments, and maintaining the Platform.

Clear definitions allow both parties to understand their rights and obligations, minimizing ambiguity and preventing disputes.

Scope of Services


2.1. Nature of Service

Indian Yoga School operates as an online listing platform and booking facilitator. We provide tools for:

  • Yoga Centres to create, manage, and publish Program listings.

  • Students and Guests to browse, filter, and book Programs.

  • Secure online payment processing (via payment partners or platforms).

  • Communication between Users and Yoga Centres.

  • Collection and settlement of payments (as an intermediary).

The Platform does not own, operate, or control the yoga centres or Programs listed, nor does it directly provide yoga instruction or related services.

2.2. Key Features

  • Vendor registration, program listing, and profile creation.

  • Student & Guest registration, booking management, user reviews.

  • Search and filter functionalities for yoga-related Programs.

  • Secure online payment via payment partners or platforms, with automated receipts.

  • Cancellation and refund processing as per stated policies.

  • Data privacy, security, and account management tools.

  • Communication and notifications between Users and Vendors.

  • Dispute management mechanisms between Users and Vendors.

2.3. Limitations

IYS serves solely as an intermediary. The contractual relationship for any yoga Program is between the Student & Guest and the Yoga Centre. IYS is not liable for the performance, safety, quality, or legality of any Program or for interactions that occur off-platform.

We reserve the right to modify, suspend, or discontinue all or part of our Platform at any time.

Account Registration, Eligibility, and Security


3.1. Eligibility

  • Users must be at least 18 years of age to register, book, or participate in any Programs through the Platform.

  • By registering, you warrant that you have the legal capacity to enter into this contract and provide information that is true, current, and complete.

3.2. Account Creation

To utilize Platform services such as listing Programs, making bookings, or processing payments, users must create an Account by providing required identification, contact, and profile information. You are responsible for the accuracy, completeness, and timely updating of your Account details.

Each user/organisation may only register one account. Transfer, sale, or assignment of accounts is prohibited.

3.3. Security and Confidentiality

You are solely responsible for safeguarding your login credentials. Sharing, transfer, or unauthorized access to your account is strictly prohibited. Any suspected breach (such as password compromise, identity theft, or account misuse) must be reported to IYS immediately.

IYS reserves the right to suspend or terminate accounts or restrict access in cases of suspected fraud, misuse, or violation of these Terms.

Payment Terms, Gateways, and Security


4.1. Payment System

IYS integrates trusted third-party payment processors to facilitate secure online transactions.

  • Payment can be made through credit card, debit card, UPI, PayPal, Stripe, or other methods as updated on our Platform.

  • All price information is displayed in INR or USD, based on the Program location and user settings. For Indian Students & Guests, fees are applicable in INR, while International Students & Guests are required to pay the fees in USD.

  • Payment processing may be subject to the respective payment provider’s terms, including potential additional fees or conversion charges.

4.2. Booking Payment Process

  • Students & Guests are required to pay the displayed booking fee at the time of Program reservation, either as specified by the Yoga Centre’s deposit requirements or in accordance with the Program’s payment terms.

  • Upon completion, the User and Vendor receive a transaction notification and payment receipt via email and within the Platform.

4.3. Vendor Settlements

  • IYS collects payments on behalf of Yoga Centres and remits the relevant amount after deducting the agreed Platform Service Fee. Settlement timelines and procedures will be published on the Platform and may be subject to banking or payment provider processing intervals.

  • IYS is not responsible for failed, delayed, or misdirected settlements due to Vendor bank/account errors/lethargy on their part.

  • Any taxes, GST, or local levies arising from payments or receipts are the responsibility of the recipient (Vendor or Student).

4.4. Payment Security and Data

  • Payment data is encrypted and processed by trusted payment partners or platforms in accordance with PCI DSS compliance standards. IYS does not store full card or payment information.

  • For integration security, all API calls and token exchanges are made over encrypted HTTPS, with access control and monitoring as per best practices.

If payment or settlement disputes occur, Users and Vendors shall contact IYS support for resolution as per our Dispute Resolution Policy.

Booking, Program Reservations, and Cancellations


5.1. Program Listing and Information

Yoga Centres are solely responsible for the accuracy, completeness, and legality of content published in each Program listing, including schedule, pricing, instructor credentials, accommodation, and policies.

5.2. Booking Process

  • Students and Guests may book Programs directly via the Platform, selecting available dates and options.

  • Booking confirmation is generated once payment or deposit is received as per the Vendor's stated policies.

  • The contract for Program participation is between the Student and the Yoga Centre, with IYS acting as an intermediary.

5.3. Cancellations and Refunds

Cancellation and refund policies are set by individual Yoga Centres and disclosed in the Program listing at the time of booking:

Note: Actual policies may vary program by program and must be reviewed before booking. Exceptions—such as for force majeure events, COVID-19-like emergencies, or venue closures—will be specified for each Program.

All cancellation requests must be made in writing via the Platform or to support contacts provided. Refunds, if any, will be processed to the original payment method within 14 business days after acceptance of a valid cancellation.

5.4. Transfers and Modifications

Some Yoga Centres may allow one-time transfer of a booking to another eligible individual or deferment to a future batch without additional cost, as disclosed in the Program policy. User requests for date or participant change will be subject to availability and Vendor approval.

Vendor Obligations and Settlements


6.1. Vendor (Yoga Centre) Responsibilities

Each Vendor is responsible for:

  • Ensuring the truthfulness, completeness, and regular update of their profile and Program listings.

  • Disclosing all fees (including hidden fees, taxes, etc.), program inclusions/exclusions, and deposit/cancellation policies clearly at the time of listing and during the booking process.

  • Honouring all confirmed bookings unless program cancellation occurs due to force majeure or other genuine cause; in such cases, notifying Students and Guests  immediately and offering a refund or suitable alternative.

  • Providing accurate settlement information to enable timely receipt of payments from IYS.

  • Maintaining adequate insurance or adhering to applicable local laws and health/safety guidelines for public events/classes.

  • Resolving any disputes or complaints from Students and Guests in good faith, and cooperating with IYS in dispute resolution.

6.2. Program Quality and Legal Compliance

Vendors must possess all necessary local or national accreditations, certifications, and permits to deliver yoga programs, and act in compliance with the Consumer Protection Act among other regulations.

IYS reserves the right to verify Vendor credentials, investigate complaints, or suspend Vendor listings and settlements in cases of fraud, repeated complaints, or regulatory violations.

User Conduct and Prohibited Activities


7.1. Conduct Standards

Users (Students, Guests and Vendors) agree not to:

  • Violate applicable local, state, national, or international laws, health regulations, or public order.

  • Submit or upload content (including reviews) that is defamatory, obscene, false, harassing, or infringes third-party rights.

  • Engage in spamming, phishing, malware transmission, unauthorized access, impersonation, data scraping, or any other abusive, illegal, or disruptive conduct on the Platform.

  • Misrepresent themselves, their health status, or their legal eligibility to participate in yoga programs.

  • Attempt to disrupt or hack the Platform, servers, or integrated payment systems.

  • Attempt to book or deliver services outside the Platform to evade agreed fees or processing.

Vendors additionally warrant not to publish false credentials or qualifications, or to misrepresent the program’s content, accommodation, dietary inclusions, or other material elements.

7.2. Enforcement

Violations of these standards result in immediate suspension/termination of accounts, forfeiture of listings, cancellation of bookings, refusal of payment settlements, and potential legal action. IYS reserves the right to remove any content or account that violates community guidelines or applicable laws18.

Intellectual Property Rights


8.1. IYS Platform Content

The Platform and all associated intellectual property—including but not limited to website design, layout, code, logos, branding, text, photos not uploaded by users, and other proprietary material—are owned or licensed by IYS. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for permitted purposes, and must not copy, redistribute, reverse-engineer, or use any content for unauthorized commercial purposes.

8.2. Vendor/Third-Party Content

Yoga Centres retain all rights in content they submit (program descriptions, photos, videos, branding). By submitting content, Vendors grant IYS a non-exclusive, royalty-free, worldwide right to use, display, reproduce, and distribute such content for the purposes of listing, promoting, or improving the Platform, and for limited public relations or social sharing purposes. Vendors warrant that they own or have obtained rights to all submitted content.

8.3. Copyright Claims

IYS responds promptly to valid claims of copyright/trademark infringement; users may notify IYS via contact methods published on the Platform. IYS may remove any infringing content or suspend repeat infringers.

User-Generated Content and Licensing


9.1. Reviews, Comments, and Uploads

Users acknowledge that content they upload (reviews, feedback, questions, testimonials, etc.) may be publicly displayed. IYS reserves the right to moderate, remove, or edit submissions in line with Platform policies.

9.2. Content Rights

By posting or submitting content, you grant IYS a worldwide, royalty-free, sublicensable, non-exclusive license for as long as your account persists or as necessary to operate or promote the Platform. You remain responsible for any personal or third-party rights implicated by your content, and for obtaining necessary consents.

Disclaimers and Warranties


10.1. General Disclaimer

The Services, Platform, content, and integrations (including payment and listing functionality) are provided “as is” and “as available” without warranty of any kind. To the extent permitted by law, IYS expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including:

  • Fitness for a particular purpose;

  • Non-infringement;

  • Merchantability;

  • Security, uninterrupted availability, error-free operation, or suitability for your particular needs.

IYS does not warrant, endorse, guarantee, or assume responsibility for any program, content, advice, statement, or action performed by a Yoga Centre or other third party.

10.2. Health Disclaimer

Yoga involves physical and mental exertion that can be strenuous. By booking or attending a Program, you acknowledge your voluntary participation and confirm you have consulted a medical professional (if appropriate) and assume full responsibility for your fitness and any consequences. The Platform and Vendors do not provide medical, therapeutic, or diagnostic advice.

Limitation of Liability


11.1. Scope of Limitation

To the maximal extent permitted by law, IYS, its directors, officers, employees, affiliates, and agents, shall not be liable for any indirect, incidental, consequential, punitive, exemplary, or special damages, or for any loss of profits, data, goodwill, business interruption, or anticipated savings, arising from or relating to:

  • Use or inability to use the Platform or Services;

  • Third-party programs, listings, or content;

  • Errors, omissions, or technical issues;

  • Unauthorized access or alteration to user data or content;

  • Program cancellation, health incidents, travel changes, force majeure events, or safety incidents at listed venues.

In all events, IYS’s cumulative liability shall not exceed the total fees paid by you (if any) to IYS in the 12 months preceding the claim.

11.2. Non-Excludable Liabilities

This limitation does not intend to exclude liability for death, personal injury due to gross negligence, fraud, or other forms of liability not permitted by applicable law to be excluded or limited.

Indemnification


To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless IYS and its officers, employees, and agents from any and all claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising from or relating to:

  • Your use or misuse of the Platform;

  • Your content submissions or actions in breach of these Terms;

  • Disputes with Yoga Centres or other users;

  • Violation of any third-party rights (including intellectual property, privacy, or contract rights);

  • Any negligence or willful misconduct related to your Platform usage.

IYS reserves the right to assume control over the defense of any claim subject to indemnification, in which case you must cooperate.

Governing Law and Dispute Resolution


13.1. Governing Law

These Terms are governed by the laws of India, specifically the jurisdiction in which IYS is registered. In any case, Indian Contract Act, 1872, Consumer Protection Act, and the Information Technology Act, 2000 apply where relevant.

13.2. Dispute Resolution

  • Initial Resolution: We encourage users to contact our support team at [support@indianyogaschool.com] for prompt, amicable resolution of issues.

  • Escalation: Any disputes, controversies, or claims arising out of these Terms, Platform policies, or service usage, which remain unresolved, shall be referred to confidential arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Dehradun, Uttarakhand, unless otherwise agreed.

  • Jurisdiction: Subject to the above, courts of Dehradun shall have exclusive jurisdiction over any legal proceedings.

Nothing herein prevents either party from seeking injunctive or equitable relief to prevent misuse of confidential information or violation of intellectual property.

Modification and Termination of Service


14.1. Modification of Terms and Service

IYS reserves the right to modify these Terms or any aspect of the Platform (including fees, features, or policies), either temporarily or permanently, at any time and for any reason. If we make significant changes, we will provide reasonable advance notice (e.g., 30 days) via email or Platform notification, except where immediate change is required by law or for reasons of safety or compliance.

Your continued use of the Platform following any change constitutes your acceptance. If you do not agree, you may terminate your account as per Section 14.228.

14.2. Termination of Account/Service

  • Users may terminate their account at any time via the Platform or via written request to support contacts.

  • IYS may suspend or terminate your access for violation of these Terms, illegal activity, misuse, or at its sole discretion with or without notice.

  • Upon termination, your license to use the Platform ceases, and all content submissions may be deleted except as required by law or our Privacy Policy. Unless otherwise stated, no fees are refunded upon voluntary termination, except where required by applicable refund policy or law.

Privacy and Data Security


15.1. Data Collection, Processing, and Use

IYS’s collection, use, and storage of your data is governed by our published Privacy Policy, which is incorporated by reference.** By registering or using the Platform, Users consent to the processing, storage, and transfer of personal information strictly for the purposes necessary to provide the Services, process payments, facilitate dispute resolution, and as required by law**.

15.2. Data Security

  • We implement technical and organizational measures to safeguard your personal data, including encryption of payment and sensitive personal information, access controls, regular vulnerability testing, security monitoring, and compliance with applicable data protection standards.

  • Sensitive payment information is handled exclusively via secure third-party gateways (PayPal, Stripe) and is not stored or accessible by IYS.

  • Users are responsible for maintaining the confidentiality of their own account credentials and for promptly updating any account or security information.

  • In case of a data breach, you will be notified promptly per the applicable notification laws and in accordance with best practices for data breach response.

15.3. Consent, Rights, and Choices

  • You have the right to access, correct, delete, or port your personal data as provided by law.

Miscellaneous


16.1. Entire Agreement

These Terms, together with our Privacy Policy and explicit Vendor Agreements (where applicable), represent the entire agreement between you and IYS regarding Platform use, and supersede any prior agreements, understandings, or representations.

16.2. Severability

If any provision of these Terms is found invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

16.3. Waiver

No waiver of any term shall be deemed further or continuing waiver of such term or any other.
